Doba trvania pracovn\u00e9ho pomeru ovplyv\u0148uje v\u00fd\u0161ku odstupn\u00e9ho, o ktorom hovor\u00ed Z\u00e1konn\u00edk pr\u00e1ce v \u00a776.<\/p>\n<p>Odstupn\u00e9 sa t\u00fdka ukon\u010denia pracovnej zmluvy, nie zml\u00fav mimo pracovn\u00e9ho pomeru, tzv. doh\u00f4d. N\u00e1rok na odstupn\u00e9 zo Z\u00e1konn\u00edka pr\u00e1ce vznik\u00e1 v\u00a0t\u00fdchto pr\u00edpadoch:<\/p>\n<ul>\n<li>Zamestn\u00e1vate\u013e sa zru\u0161uje bez n\u00e1stupcu a\u00a0firma kon\u010d\u00ed svoju \u010dinnos\u0165.<\/li>\n<li>Zamestn\u00e1vate\u013e sa premiest\u0148uje a\u00a0zamestnanec nes\u00fahlas\u00ed so zmenou miesta v\u00fdkonu pr\u00e1ce.<\/li>\n<li>Zamestn\u00e1vate\u013e uskuto\u010dnil organiza\u010dn\u00e9 zmeny a\u00a0zamestnanec sa stal nadbyto\u010dn\u00fdm.<\/li>\n<li>Ak zamestnanec strat\u00ed dlhodob\u00fa sp\u00f4sobilos\u0165 vykon\u00e1va\u0165 pr\u00e1cu pre nepriazniv\u00fd zdravotn\u00fd stav potvrden\u00fd zdravotn\u00fdm posudkom.<\/li>\n<li>Ak zamestnanec nem\u00f4\u017ee vykon\u00e1va\u0165 pr\u00e1cu kv\u00f4li pracovn\u00e9mu \u00farazu alebo choroby z\u00a0povolania.<\/li>\n<\/ul>\n<p>Odstupn\u00e9 vznik\u00e1 aj v\u00a0pr\u00edpade, ak d\u00f4jde k\u00a0dohode medzi zamestn\u00e1vate\u013eom a\u00a0zamestnancom a\u00a0je v\u00a0nej uveden\u00fd jeden z\u00a0hore uveden\u00fdch d\u00f4vodov.<\/p>\n<p><strong>Pr\u00edklad:<\/strong><\/p>\n<p>Z\u00a0d\u00f4vodu zmeny dod\u00e1vate\u013esk\u00fdch vz\u0165ahov a\u00a0sp\u00f4sobu obchodovania po\u010das pand\u00e9mie Covid-19 sa zamestn\u00e1vate\u013e rozhodol dohodn\u00fa\u0165 sa zamestnancom Ivanom o\u00a0ukon\u010den\u00ed pracovn\u00e9ho pomeru, nako\u013eko nem\u00e1 pre neho pr\u00e1cu. V\u00a0 Dohode o\u00a0ukon\u010den\u00ed pracovn\u00e9ho pomeru je uveden\u00fd d\u00f4vod ukon\u010denia pracovn\u00e9ho pomeru ako zmena organiz\u00e1cie pr\u00e1ce. Ivan m\u00e1 n\u00e1rok na odstupn\u00e9 vo v\u00fd\u0161ke dvojn\u00e1sobku svojej priemernej mesa\u010dnej mzdy, nako\u013eko jeho pracovn\u00fd pomer trval viac ne\u017e dva roky a\u00a0pracovn\u00fd pomer bol ukon\u010den\u00fd dohodou.<\/p>\n<p>Ak by nastala toto\u017en\u00e1 situ\u00e1cia, av\u0161ak\u00a0 zamestn\u00e1vate\u013e by ukon\u010dil pracovn\u00fd pomer v\u00fdpove\u010fou, Ivanovi tie\u017e vznik\u00e1 n\u00e1rok na odstupn\u00e9, preto\u017ee v\u00fdpove\u010f dostal z\u00a0d\u00f4vodu organiza\u010dnej zmeny. V\u00fd\u0161ka odstupn\u00e9ho by bola vyr\u00e1tan\u00e1 pod\u013ea doby trvania pracovn\u00e9ho pomeru, \u010di\u017ee vo v\u00fd\u0161ke priemernej mesa\u010dnej mzdy, ale z\u00e1rove\u0148 by mu plynula aj v\u00fdpovedn\u00e1 lehota. Zamestn\u00e1vate\u013e by mu vyplatil odmenu aj za mesiace, po\u010das ktor\u00fdch v\u00fdpovedn\u00e1 doba plynula a\u00a0n\u00e1sledne aj odstupn\u00e9. V\u00fdpovedn\u00e1 lehota by bola v\u00a0tomto pr\u00edpade najmenej dva mesiace.
