Z\u00e1konn\u00edk pr\u00e1ce v znen\u00ed neskor\u0161\u00edch predpisov (\u010falej len \u201eZ\u00e1konn\u00edk pr\u00e1ce\u201c v pr\u00edslu\u0161nom tvare) sa <strong>m\u00f4\u017ee pracovn\u00fd pomer skon\u010di\u0165 najm\u00e4<\/strong>:<\/p>\n<ul>\n<li>dohodou o skon\u010den\u00ed pracovn\u00e9ho pomeru,<\/li>\n<li>v\u00fdpove\u010fou pracovn\u00e9ho pomeru,<\/li>\n<li>okam\u017eit\u00fdm skon\u010den\u00edm pracovn\u00e9ho pomeru,<\/li>\n<li>skon\u010den\u00edm pracovn\u00e9ho pomeru v sk\u00fa\u0161obnej dobe,<\/li>\n<li>uplynut\u00edm doby, na ktor\u00fa bol pracovn\u00fd pomer dohodnut\u00fd.<\/li>\n<\/ul>\n<p>Ak v\u00fdpove\u010f alebo okam\u017eit\u00e9 skon\u010denie pracovn\u00e9ho pomeru d\u00e1va zamestn\u00e1vate\u013e, je povinn\u00fd ho vopred <strong>prerokova\u0165 so z\u00e1stupcami zamestnancov<\/strong>, inak s\u00fa neplatn\u00e9. Ak u neho z\u00e1stupcovia zamestnancov nep\u00f4sobia, m\u00f4\u017ee kona\u0165 samostatne.<\/p>\n<h2>Skon\u010denie pracovn\u00e9ho pomeru dohodou<\/h2>\n<p>V tomto pr\u00edpade ide o skon\u010denie pracovn\u00e9ho pomeru na z\u00e1klade obojstrannej dohody medzi zamestnancom a zamestn\u00e1vate\u013eom. Pracovn\u00fd pomer sa skon\u010d\u00ed d\u0148om, na ktorom sa medzi sebou zmluvn\u00e9 strany dohodn\u00fa a uved\u00fa ho v dohode. Dohoda o skon\u010den\u00ed pracovn\u00e9ho pomeru mus\u00ed by\u0165 <strong>uzatvoren\u00e1 v p\u00edsomnej podobe<\/strong>. Jedno vyhotovenie dohody o skon\u010den\u00ed pracovn\u00e9ho pomeru d\u00e1 zamestn\u00e1vate\u013e zamestnancovi.<\/p>\n<p>Ak to zamestnanec nepo\u017eaduje, <strong>d\u00f4vody skon\u010denia pracovn\u00e9ho pomeru dohodou<\/strong> v nej uveden\u00e9 by\u0165 nemusia. Ak to po\u017eaduje, tak v nej uveden\u00e9 by\u0165 musia. Ak sa v\u0161ak pracovn\u00fd pomer skon\u010dil dohodou z ni\u017e\u0161ie vymenovan\u00fdch d\u00f4vodov, mus\u00ed to by\u0165 v dohode o skon\u010den\u00ed pracovn\u00e9ho pomeru povinne uveden\u00e9:<\/p>\n<ul>\n<li>zamestn\u00e1vate\u013e alebo jeho \u010das\u0165 sa zru\u0161uje,<\/li>\n<li>zamestn\u00e1vate\u013e alebo jeho \u010das\u0165 sa premiest\u0148uje a zamestnanec nes\u00fahlas\u00ed so zmenou dohodnut\u00e9ho miesta v\u00fdkonu pr\u00e1ce,<\/li>\n<li>zamestnanec sa stal nadbyto\u010dn\u00fd,<\/li>\n<li>zamestnanec vzh\u013eadom na svoj zdravotn\u00fd stav pod\u013ea lek\u00e1rskeho posudku dlhodobo stratil sp\u00f4sobilos\u0165 vykon\u00e1va\u0165 doteraj\u0161iu pr\u00e1cu alebo ju nesmie vykon\u00e1va\u0165 pre chorobu z povolania alebo pre ohrozenie touto chorobou.<\/li>\n<\/ul>\n<h2>V\u00fdpove\u010f pracovnej zmluvy \u2013 d\u00f4vody, pre ktor\u00e9 ju mo\u017eno da\u0165<\/h2>\n<p>V\u00fdpove\u010f mus\u00ed by\u0165 <strong>p\u00edsomn\u00e1 a doru\u010den\u00e1<\/strong> druhej strane, inak je neplatn\u00e1. Zamestnanec m\u00f4\u017ee da\u0165 zamestn\u00e1vate\u013eovi v\u00fdpove\u010f z ak\u00e9hoko\u013evek d\u00f4vodu alebo bez uvedenia d\u00f4vodu.<\/p>\n<p>Zamestn\u00e1vate\u013e m\u00f4\u017ee da\u0165 zamestnancovi v\u00fdpove\u010f <strong>iba z nasleduj\u00facich d\u00f4vodov<\/strong>, pri\u010dom d\u00f4vod v\u00fdpovede mus\u00ed by\u0165 v nej skutkovo vymedzen\u00fd tak, aby nebol zamenite\u013en\u00fd s in\u00fdm:<\/p>\n<ul>\n<li>zamestn\u00e1vate\u013e alebo jeho \u010das\u0165 sa zru\u0161uje,<\/li>\n<li>zamestn\u00e1vate\u013e alebo jeho \u010das\u0165 sa premiest\u0148uje a zamestnanec nes\u00fahlas\u00ed so zmenou dohodnut\u00e9ho miesta v\u00fdkonu pr\u00e1ce,<\/li>\n<li>zamestnanec je nadbyto\u010dn\u00fd vzh\u013eadom na p\u00edsomn\u00e9 rozhodnutie zamestn\u00e1vate\u013ea o zmene jeho \u00faloh, technick\u00e9ho vybavenia alebo o zn\u00ed\u017een\u00ed stavu zamestnancov s cie\u013eom zabezpe\u010di\u0165 efekt\u00edvnos\u0165 pr\u00e1ce alebo o in\u00fdch organiza\u010dn\u00fdch zmen\u00e1ch,<\/li>\n<li>zamestnanec vzh\u013eadom na svoj zdravotn\u00fd stav pod\u013ea lek\u00e1rskeho posudku dlhodobo stratil sp\u00f4sobilos\u0165 vykon\u00e1va\u0165 doteraj\u0161iu pr\u00e1cu alebo ju nesmie vykon\u00e1va\u0165 pre chorobu z povolania alebo pre ohrozenie touto chorobou,<\/li>\n<li>zamestnanec nesp\u013a\u0148a predpoklady ustanoven\u00e9 pr\u00e1vnymi predpismi na v\u00fdkon pr\u00e1ce,<\/li>\n<li>zamestnanec prestal sp\u013a\u0148a\u0165 po\u017eiadavku pre vznik pracovn\u00e9ho pomeru, ktorou je vo\u013eba alebo vymenovanie do funkcie \u0161tatut\u00e1rneho org\u00e1nu alebo do funkcie ved\u00faceho zamestnanca v priamej riadiacej p\u00f4sobnosti \u0161tatut\u00e1rneho org\u00e1nu,<\/li>\n<li>zamestnanec nesp\u013a\u0148a bez zavinenia zamestn\u00e1vate\u013ea po\u017eiadavky na riadny v\u00fdkon dohodnutej pr\u00e1ce ur\u010den\u00e9 zamestn\u00e1vate\u013eom vo vn\u00fatornom predpise,<\/li>\n<li>zamestnanec neuspokojivo pln\u00ed pracovn\u00e9 \u00falohy a zamestn\u00e1vate\u013e ho v posledn\u00fdch \u0161iestich mesiacoch p\u00edsomne vyzval na odstr\u00e1nenie nedostatkov a zamestnanec ich v primeranom \u010dase neodstr\u00e1nil,<\/li>\n<li>u zamestnanca s\u00fa d\u00f4vody, pre ktor\u00e9 by s n\u00edm zamestn\u00e1vate\u013e mohol okam\u017eite skon\u010di\u0165 pracovn\u00fd pomer alebo pre menej z\u00e1va\u017en\u00e9 poru\u0161enie pracovnej discipl\u00edny (v pr\u00edpade menej z\u00e1va\u017en\u00e9ho poru\u0161enia pracovnej discipl\u00edny len vtedy, ak bol v posledn\u00fdch \u0161iestich mesiacoch pre to p\u00edsomne upozornen\u00fd na mo\u017enos\u0165 v\u00fdpovede).<\/li>\n<\/ul>\n<link rel=\"stylesheet\" Pozor v\u0161ak na to, \u017ee v\u00fdpovedn\u00e1 doba <strong>za\u010d\u00edna plyn\u00fa\u0165 od prv\u00e9ho d\u0148a kalend\u00e1rneho mesiaca<\/strong> nasleduj\u00faceho po doru\u010den\u00ed v\u00fdpovede a skon\u010d\u00ed sa uplynut\u00edm posledn\u00e9ho d\u0148a pr\u00edslu\u0161n\u00e9ho kalend\u00e1rneho mesiaca.<\/p>\n<h2>Kedy zamestn\u00e1vate\u013e nem\u00f4\u017ee da\u0165 zamestnancovi v\u00fdpove\u010f<\/h2>\n<p>Zamestn\u00e1vate\u013e nem\u00f4\u017ee da\u0165 zamestnancovi v\u00fdpove\u010f<strong> v tzv. \u201eochrannej dobe\u201c<\/strong>, teda:<\/p>\n<ul>\n<li>v dobe, ke\u010f je zamestnanec uznan\u00fd za do\u010dasne pr\u00e1ceneschopn\u00e9ho pre chorobu alebo \u00faraz, ak si ju \u00famyselne nevyvolal alebo nesp\u00f4sobil pod vplyvom alkoholu, omamn\u00fdch l\u00e1tok alebo psychotropn\u00fdch l\u00e1tok,<\/li>\n<li>odo d\u0148a, ke\u010f bol zamestnanec povolan\u00fd na v\u00fdkon mimoriadnej slu\u017eby alebo mu bol v\u00fdkon mimoriadnej slu\u017eby nariaden\u00fd, a\u017e do dvoch t\u00fd\u017ed\u0148ov po jeho prepusten\u00ed z nej,<\/li>\n<li>v dobe, ke\u010f je zamestnanec uvo\u013enen\u00fd na v\u00fdkon dobrovo\u013enej vojenskej pr\u00edpravy, na pravideln\u00e9 cvi\u010denie alebo na plnenie \u00faloh ozbrojen\u00fdch s\u00edl Slovenskej republiky,<\/li>\n<li>v dobe, ke\u010f je zamestnanky\u0148a tehotn\u00e1, ke\u010f je zamestnanky\u0148a na materskej dovolenke, od ozn\u00e1menia predpokladan\u00e9ho d\u0148a n\u00e1stupu na otcovsk\u00fa dovolenku zamestnancom (najsk\u00f4r \u0161es\u0165 t\u00fd\u017ed\u0148ov predch\u00e1dzaj\u00facich o\u010dak\u00e1van\u00e9mu d\u0148u p\u00f4rodu) do skon\u010denia otcovskej dovolenky, ke\u010f je zamestnanky\u0148a a zamestnanec na rodi\u010dovskej dovolenke alebo v dobe, ke\u010f sa osamel\u00e1 zamestnanky\u0148a alebo osamel\u00fd zamestnanec staraj\u00fa o die\u0165a mlad\u0161ie ako tri roky,<\/li>\n<li>v dobe, ke\u010f je zamestnanec dlhodobo uvo\u013enen\u00fd na v\u00fdkon verejnej funkcie,<\/li>\n<li>v dobe, ke\u010f je zamestnanec pracuj\u00faci v noci uznan\u00fd na z\u00e1klade lek\u00e1rskeho posudku do\u010dasne nesp\u00f4sobil\u00fdm na no\u010dn\u00fa pr\u00e1cu.<\/li>\n<\/ul>\n<p>Z\u00e1konn\u00edk pr\u00e1ce ale v <a href=\"https:\/\/www.slov-lex.sk\/pravne-predpisy\/SK\/ZZ\/2001\/311\/#paragraf-64.odsek-3\" target=\"_blank\" rel=\"noopener\">\u00a7 64 ods. 3<\/a> prip\u00fa\u0161\u0165a nieko\u013eko situ\u00e1ci\u00ed, kedy m\u00f4\u017ee da\u0165 zamestn\u00e1vate\u013e zamestnancovi <strong>v\u00fdpove\u010f aj vo vy\u0161\u0161ie uvedenej ochrannej dobe<\/strong>.<\/p>\n<h2>Okam\u017eit\u00e1 v\u00fdpove\u010f, resp. okam\u017eit\u00e9 skon\u010denie pracovn\u00e9ho pomeru<\/h2>\n<p><strong>Zamestnanec m\u00f4\u017ee okam\u017eite skon\u010di\u0165 pracovn\u00fa zmluvu<\/strong> z t\u00fdchto d\u00f4vodov:<\/p>\n<ul>\n<li>pod\u013ea lek\u00e1rskeho posudku nem\u00f4\u017ee \u010falej vykon\u00e1va\u0165 pr\u00e1cu bez v\u00e1\u017eneho ohrozenia svojho zdravia a zamestn\u00e1vate\u013e ho nepreradil do 15 dn\u00ed odo d\u0148a predlo\u017eenia tohto posudku na in\u00fa pre neho vhodn\u00fa pr\u00e1cu,<\/li>\n<li>zamestn\u00e1vate\u013e mu nevyplatil mzdu, n\u00e1hradu mzdy, cestovn\u00e9 n\u00e1hrady, n\u00e1hradu za pracovn\u00fa pohotovos\u0165, n\u00e1hradu pr\u00edjmu pri do\u010dasnej pracovnej neschopnosti zamestnanca alebo ich \u010das\u0165 do 15 dn\u00ed po uplynut\u00ed ich splatnosti,<\/li>\n<li>je bezprostredne ohrozen\u00fd jeho \u017eivot alebo zdravie.<\/li>\n<\/ul>\n<p>Ak nastane niektor\u00fd z vy\u0161\u0161ie uveden\u00fdch d\u00f4vodov, pre ktor\u00fd by mohol zamestnanec okam\u017eite skon\u010di\u0165 pracovn\u00fd pomer, mus\u00ed si to pomerne r\u00fdchlo premyslie\u0165. Pracovn\u00fd pomer m\u00f4\u017ee okam\u017eite skon\u010di\u0165 <strong>iba v lehote jedn\u00e9ho mesiaca<\/strong> odo d\u0148a, ke\u010f sa o tomto d\u00f4vode dozvedel. Ak by v\u0161ak s vedom\u00edm zamestn\u00e1vate\u013ea aj potom zamestnanec pokra\u010doval vo v\u00fdkone pr\u00e1ce, plat\u00ed, \u017ee pracovn\u00fd pomer sa zmenil na pracovn\u00fd pomer na dobu neur\u010dit\u00fa.<\/p>\n<p><strong>Po\u010das plynutia sk\u00fa\u0161obnej doby<\/strong> m\u00f4\u017ee ukon\u010di\u0165 pracovn\u00fa zmluvu tak zamestnanec, ako aj zamestn\u00e1vate\u013e. M\u00f4\u017eu tak urobi\u0165 aj bez uvedenia d\u00f4vodu.
